A IP e a comunicação social
criaram a convicção que o regulamento 2024/1679 no artigo 17.2 determinava a
realização até 19jul2026 de uma avaliação e ACB justificando eventualmente a
não construção de novas linhas em bitola europeia.
Recentemente a imprensa espanhola e a seguir a portuguesa divulgaram o envio pelo Ministerio de Transportes espanhol à Comissão Europeia/DG MOVE de um relatório recusando a "migração" da rede de bitola ibérica existente para bitola europeia. Dir-se-ia que o relatório terá tido importante colaboração da IP e seus consultores dada a similitude de argumentos e o conservdorismo assumido de manutenção a todo o preço da bitola ibérica.
Posso estar errado, mas a minha
interpretação do texto do regulamento é diferente. Não existia em julho de 2024
nenhum planeamento de linha de ligação transfronteiriça de acordo com o Anexo I
que não estivesse já planeada (ver os mapas abaixo com indicação dos respetivos
calendários core, extended core e comprehensive), logo não havia que realizar
nenhuma ACB naquele sentido (nem na avaliação da migração para europeia de toda
a rede ibérica pré existente). O que o artigo 17.3 determinava era essa ACB para
o caso de em julho de 2024 existirem linhas de bitola ibérica coincidentes com
corredores internacionais (caso do troço ÉvoraN-Caia).

paragraph 1 of this Article, the Member States on the territory of which,
on 18 July 2024, no new railway line is planned to be connected to the
land border of another Member State according to Annex I, shall draw up a
plan identifying the new railway line to be built in accordance with the
European standard nominal track gauge of 1 435 mm … The plan shall
include a socio-economic cost-benefit analysis justifying the decision of the
Member State, where relevant, not to build new railway infrastructure to
the European standard nominal track gauge of 1 435 mm and an
assessment of the impact on interoperability. That plan shall be submitted to
the Commission by 19 July 2026.
2. Em derrogação
do n.o 1 do presente artigo, os Estados-Membros em cujo território não
exista, em 18 de julho de 2024, nenhum plano de construção de
uma nova linha ferroviária de ligação à fronteira terrestre de outro
Estado-Membro, de acordo com o anexo I, elaboram um plano que indique a
nova linha ferroviária a construir, em conformidade com a bitola nominal da
norma europeia de 1435 mm ... O plano deve incluir uma análise dos custos
e benefícios socioeconómicos que justifique a decisão do Estado-Membro no
sentido de, se for caso disso, não construir novas infraestruturas ferroviárias
em conformidade com a bitola nominal da norma europeia
de 1 435 mm e uma avaliação do impacto na interoperabilidade.
Esse plano é apresentado à Comissão até 19 de julho de 2026
Ora, como pode ver-se nos mapas
do Anexo I, em julho de 2024 já estavam planeadas para ligações
transfronteiriças Lisboa-Madrid (core -2030), Aveiro-Salamanca e Porto-Vigo
(extended core - 2040) e Faro-Huelva (comprehensive - 2050) . Trata-se portanto
de um plano determinado bem definido, não sujeito a ACB negativas.
O que o art.17.5 diz é que a
pedido do Estado membro e em coordenação com o vizinho pode ser concedida uma
isenção temporária de cumprimento da bitola europeia, mas sempre temporária,
não definitiva (em notícia informal, anunciou-se a intenção da IP de pedir
uma isenção temporária até 2040, o que obrigará a uma duplicação de custos, no
início em bitola ibérica, em 2040 mudqança para bitola europeia com as perturbações
de tráfego decorrentes, mais grave se troços em via única). [1]
É interessante ver o desvio de
tradução: em vez de, relativamente a julho de 2024, "no new railway
line is planned to be connected to the land border" a versão portuguesa
diz "nenhum plano de construção de uma nova linha ferroviária de
ligação à fronteira terrestre". De facto, em julho de 2024 não havia
contratos para construção e respetivos planos de construção (à exceção de
ÉvoraN-Caia que se insere no art.17.3). Trata-se portanto de um erro de
tradução ou um ardil para apresentar uma ACB previamente orientada no sentido
negativo (até porque omitindo os custos energéticos da reduzida quota modal
ferroviária comparativamente com a rodoviária, ao arrepio do Green Deal) quando
o regulamento 1679 não requer qualquer avaliação e ACB para as ligações
transfronteiriças elencadas no Anexo I, mas apenas para os troços em bitola
ibérica coincidentes com corredores internacionais conforme o art. 17.3.
No caso da versão inglesa,
original, art.17.2:
“… the Member States on the territory of which,
on 18 July 2024, no new railway line is planned to be connected to the
land border of another Member State according to Annex I, shall draw up a
plan identifying the new railway line to be built in accordance with the
European standard nominal track gauge of 1 435 mm.”
parece -me correta a seguinte
interpretação:
“... os Estados membros em cujo
território em 18jul2024 não exista nenhuma linha prevista para ligação
transfronteiriça diferente das previstas já no Anexo I (datas previstas: core
20230, extended core 2040 e comprehensive 2050) elaborarão um plano identificando
essa nova linha para ser construida com bitola 1435 mm.” (o que seria aplicável
à proposta nova linha Porto-Trás os Montes - Zamora, por exemplo).
Não foi essa a interpretação do
tradutor para português, o qual abusivamente introduziu o termo “nenhum plano
de construção” o que é diferente de linhas planeadas com indicação de datas
objetivo no Anexo I.

português, ao troço ÉvoraN-Caia[2],

European standard nominal track gauge for rail
1. Member States shall ensure that any new railway line
of the core network and the extended core network, including connections
referred to in Article 14(1), point (d), provides for the European
standard nominal track gauge of 1 435 mm. That requirement is considered
to be met when 1 435 mm track gauge trains can circulate on the
infrastructure by 31 December 2030 for the core network and by 31
December 2040 for the extended core network. For the purposes of this Article,
new railway line means any line for which construction works have not started
by 18 July 2024.
2. By way of derogation from paragraph 1 of this
Article, the Member States on the territory of which, on 18 July
2024, no new railway line is planned to be connected to the land border of
another Member State according to Annex I, shall draw up a plan
identifying the new railway line to be built in accordance with the European
standard nominal track gauge of 1 435 mm. That plan shall take account
of the impact on interoperability with the neighbouring Member State or Member
States, by taking account of, notably, the possible migration of existing
railway lines to the European standard nominal track gauge of 1 435 mm
in accordance with paragraph 3 of this Article. The plan shall include a
socio-economic cost-benefit analysis justifying the decision of the
Member State, where relevant, not to build new railway infrastructure to
the European standard nominal track gauge of 1 435 mm and an
assessment of the impact on interoperability. That plan shall be submitted to
the Commission by 19 July 2026.
3. Member States with an existing rail network, or a
part thereof, with a track gauge different from that of the European standard
nominal track gauge of 1 435 mm shall carry out an assessment, by
19 July 2026, identifying the existing railway lines located on the
European Transport Corridors in view of their possible migration to the
European standard nominal track gauge of 1 435 mm. The assessment
shall be coordinated with the neighbouring Member State or Member States
in the case of cross-border sections. The assessment shall include a
socio-economic cost-benefit analysis on the viability of the possible migration
to the European standard nominal track gauge of 1 435 mm and an
assessment of the impact on interoperability.
Based on the assessment under the first subparagraph, Member States
shall draw up a plan for migration to the European standard nominal track gauge
of 1 435 mm where relevant, at the latest one year following the
completion of the assessment, identifying the existing railway lines located on
the European Transport Corridors to be migrated to the European standard
nominal track gauge of 1 435 mm and provide for an indication of
the timeline of that migration.
First and second subparagraphs shall apply mutatis mutandis to
the railway lines for which construction works have started on 18 July
2024.
4. The priorities for infrastructure and investment
planning resulting from the plans referred to in paragraphs 2 and 3 of
this Article shall be included in the first work plan of the European
Coordinator for a European Transport Corridor of which the freight railway
lines with a track gauge different from that of the European standard nominal
track gauge is part, in accordance with Article 54.
5. At the request of a Member State, in duly justified
cases, the Commission shall adopt implementing acts granting a temporary
exemption from the requirements referred to in paragraph 1 for new railway
lines of the core network and extended core network, or for part thereof, on
the ground of negative results of socio-economic cost-benefit analysis. Any request for
exemption shall be based on sufficient justification. The requests for
exemption shall be coordinated with the neighbouring Member State or Member
States in the case of cross-border sections. The neighbouring Member States may
provide an opinion to the Member State requesting the exemption. The Member
State shall attach the opinions of the neighbouring Member States to its
request. A Member State may request the granting of several exemptions in a
single request.
The Commission shall assess the request in the light of the
justification provided as well as in terms of its significant impact on
interoperability and continuity of the railway network, where relevant. The
Commission shall take duly into account the opinions of the neighbouring Member
States concerned.
The Commission may ask for additional information from the Member State
no later than 30 calendar days following the receipt of request pursuant
to the first subparagraph. If the Commission considers that the information
provided is insufficient, it may ask the Member State to supplement that
additional information within 30 calendar days from the receipt of that
additional information.
The Commission shall take a decision on the requested exemption no later
than six months following the receipt of the request pursuant to the first
subparagraph or, in the event that further information has been provided by the
Member States concerned pursuant to the third subparagraph, no later than four
months following the latest receipt of such information, whichever is later.
The decision shall indicate the period for which the exemption is granted.
The Commission shall inform other Member States of the exemptions
granted pursuant to this Article.
No caso de Évora N-Caia deverá ter-se em consideração
que os custos de compatibilização com os requisitos do regulamento não são
apenas o da “migração” da bitola ibérica para bitola europeia, mas também os
custos da duplicação da via , que nos viadutos incluem a construção dos
tabuleiros para a segunda via
Também deverá considerar-se a hipótese de pagamento
dos direitos de projeto do consórcio Elos, evitando-se o pagamento da
indemnização transitada em julgado, em traçado de AV em bitola europeia de raiz
diferente do traçado atual convencional e compatível com circulação noturna de
mercadorias.
Eventualmente,
dependente da localização das plataformas logísticas rodo-ferroviárias, poderão
ser abrangidos pela avaliação e ACB do art.17.3 os troços coincidentes com o
corredor atlântico sul e norte (estimativa 600km/6.000 milhões €):
